Rights of Responding and Reporting Person(s)

Denison follows Office of Civil Rights Title IX guidance in developing and executing its intimate violence and gender discrimination policies and procedures. Familiarizing yourself with your rights in the investigation and adjudication processes can be important in deciding your level of participation.   • The right to receive a description of the report or allegation
  • The right to be informed where to find a description of the procedures and protocols regarding the investigation;
  • The right not to participate in the investigation process;
    • Refusing to participate or limiting participation may limit the University’s ability to discover pertinent facts and/or adjudicate.
  • Both parties will only be able to submit information regarding the University’s investigation through the investigation process, participating in interviews, providing witness names, providing documentary evidence, such as text messages and social media posts, requests to include documentary evidence such as building access record or surveillance footage, although rare and typically not relevant, providing expert testimony and/or forensic evidence.
  • The right for impartial investigators to conduct the investigation and determine relevant evidence to include.
    • The Title IX Coordinator oversees the investigation to ensure it is timely, thorough and unbiased.
    • Both parties will only be able to submit information to the University’s investigation through the investigation process by
      • participating in interviews and providing witness names
      • providing documentary evidence, such as text messages and social media posts,
      • by requesting to include documentary evidence such as building access record or surveillance footage, and although rare and typically not relevant, providing expert testimony and/or forensic evidence.
  • The right for the Title IX Office to answer any questions about the process.
  • The right to an advisor of choice.
